This Privacy Policy does not apply to the extent we process personal information on behalf of our customers, including where we offer various SaaS products and services which our customers use to collect, use, share, or process the personal information of their patients, employees, or other end users authorized by our customers. If you have questions about how a Behave customer processes your personal information, you must contact the Behave customer directly. Behave is not responsible for the privacy or data security practices of our customers, which may differ from those described in this Privacy Policy.

Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, accessible at https://behavehealth.com.

INFORMATION COLLECTION AND USE

While using our Services, we may collect certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to, your email address, name, phone number, postal address, other information ("Personal Information"). We may also collect the following types of Personal Information:

  • Identifiers: We may collect your full name, email address, physical address, phone number, IP Address, device ID, or other similar identifiers. We may also collect any other Personal Information that you provide to us, such as social media identifiers, language preference, or website URL.

  • Internet or Other Electronic Network Activity Information: We may collect information regarding your interaction with the Services, including time of visit and geolocation data, pages visited, links clicked, emails opened, language preferences, and the pages that led or referred you to our Services. How we collect Personal Information

We may collect Personal Information from the following sources:

  • We may automatically collect certain information about the computer or other devices that you use to access the Services, including mobile devices, through commonly used information-gathering tools, such as cookies and web beacons (see our Cookies section below). We may also collect information that your browser sends whenever you visit our Services ("Log Data"). Generally, we collect Personal Information for the purpose of providing the Services, identifying and communicating with you, responding to your requests/inquiries, servicing your purchase orders, and improving our Services. We process your Personal Information if we obtained your affirmative consent to such processing, such as to send you our newsletter and other marketing communications that you requested, or to respond to inquiries and questions that you initiated.

INFORMATION SHARING AND DISCLOSURE

We may share your Personal Information with third parties:

  • With your consent. We share your Personal Information if you affirmatively consent to it. If we are legally obligated to obtain your consent prior to sharing your Personal Information, we notify you of the specific purpose for which we are obtaining your consent, and we do not share beyond that purpose without notifying you of and obtaining additional consent for further disclosure.

  • With third party service providers and agents. We share Personal Information with a limited number of service providers who process it on our behalf to facilitate our Services, to provide the Services on our behalf, to perform Services-related services and/or to assist us in analyzing how our Services are used. For example, we use Google Analytics to analyze Log Data to understand how you use the Services and how we can improve your user experience. Our service providers have agreed to privacy restrictions similar to the ones in our Privacy Policy by making similar commitments. We also use third parties to help us process payments, manage our customer relationships, and operate our customer helpdesk.

  • For legal disclosure. We will disclose your Personal Information where required to do so by law, regulation, legal order, legal process, or subpoena or if we believe that such action is necessary to comply with the reasonable requests of law enforcement or to protect the security or integrity of our Services.

  • As a result of merger or sale of our business. If Behave Health Corp. is involved in a merger, acquisition, financing, liquidation, bankruptcy, or asset sale, your Personal Information may be transferred as a business asset. In such cases, we will provide notice before your Personal Information is transferred and/or becomes subject to a different Privacy Policy.

We do not sell any Personal Information for any reason, and we will not use or share your information with anyone except as described in this Privacy Policy.

You may access, update, alter, or delete certain Personal Information we have about you by contacting us using the information provided in the "Contact Us" section below.

We may use your Personal Information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us.

Our customers may use the Services to collect, use, share, or process Personal Information of their customers, end users, or other authorized representatives. Unless we state otherwise in this Privacy Policy, we process such Personal Information on behalf of our customers, who are the controllers of the Personal Information. We do not control and are not responsible for the privacy or data security practices of our customers, which may differ from those described in this Privacy Policy. If you want to exercise any rights you may have under applicable data protection laws over the Personal Information one of our customer's has about you, you must submit your request to the customer directly because we can only access your Personal Information pursuant to our customer's instructions. We will work with our customer to respond to your request.

Under the Health Insurance Portability and Accountability Act ("HIPAA"), some of the medical and/or health-related information that Behave collects, uses, process, and discloses while providing the Services to its customers may be considered protected health information ("PHI"). Behave is a "Business Associate" when it provides Services to customers who are healthcare providers, health plans, and other "covered entities" defined by HIPAA. When Behave receives PHI from or on behalf of HIPAA covered entities, the PHI is protected by HIPAA and subject to the covered entity's privacy practices and our Business Associate Agreement. We use, disclose, and process PHI only in accordance with HIPAA and our customers' instructions.

Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and transferred to your device. We use cookies to collect information in order to improve our Services for you.
